As Josep Borrell was just elected President of the European Parliament, it is worth recalling and publicising his stated position on software patentability. This position was expressed between the Council vote of 18 May 2004 and the European elections.

Summary: the socialist and Spanish governement's position is clear that restrictions to the patentability of computer-implemented inventions are needed (maintaining software outside the scope of patentable subject matter) and that copyright was enough to ensure the dynamics of software innovation.
